Online Store Terms and Conditions
§1 General Provisions
1.1. These Terms and Conditions define the rules for using the online store operated by OLGA WAŁEK FOTOGRAFIA, Tax ID: 899-287-92-63, available at https://beautyphoto.com/.
1.2. The online store available at https://beautyphoto.pl/ (hereinafter referred to as the “Online Store”) is operated by: OLGA WAŁEK FOTOGRAFIA, Szkolna 10, 98-432 Dzietrzkowice, Tax ID: 899-287-92-63.

1.4. These Terms and Conditions are continuously available on the website https://beautyphoto.pl/ in a manner that allows Customers to access, reproduce, and store their content. The Terms are also made available to Customers before concluding a contract.
§2 Definitions
The following terms shall have the meanings indicated below:
2.1. Consumer – a natural person within the meaning of Article 221 of the Polish Civil Code.
2.2. Entrepreneur with consumer rights – a natural person entering into a contract directly related to their business activity, where the contract is not of a professional nature for that person, particularly based on the registered scope of activity in the Central Register of Business Activity.
2.3. Entrepreneur – a natural person, legal entity, or organizational unit with legal capacity conducting business or professional activity in their own name.
2.4. Service Provider/Seller – OLGA WAŁEK FOTOGRAFIA, Szkolna 10, 98-432 Dzietrzkowice.
2.5. Online Store – the website available at https://beautyphoto.com/.
2.6. Civil Code – the Act of April 23, 1964.
2.7. Goods and Services – all services provided and goods sold under a sales agreement between the Seller and the Buyer.
2.8. Terms and Conditions – these Terms governing electronic services within the meaning of the Act of July 18, 2002 on Providing Services by Electronic Means.
2.9. Customer/Buyer – a natural person, legal entity, or organizational unit making or intending to make an order via the Online Store.
2.10. Order – a declaration of intent by the Customer accepting the Seller’s offer, including price, type, and quantity of Goods or Services.
2.11. Consumer Rights Act – the Act of May 30, 2014 on consumer rights.
§3 Rules for Using the Online Store
3.1. All prices listed in the Store are gross prices (including VAT) and are expressed in Polish zloty (PLN), unless stated otherwise.
3.2. Prices and descriptions on https://beautyphoto.com/ constitute commercial information and do not constitute an offer within the meaning of the Civil Code. They become binding only upon confirmation of the order by the Seller.
3.3. The Seller may use discount codes, which entitle Customers to price reductions. Discount codes are not exchangeable for cash.
3.4. Acceptance of these Terms is required to place an order.
3.5. To place an order, the Customer must have a device with Internet access and the ability to complete electronic forms.
3.6. The website uses SSL encryption to ensure secure communication.
§4 Conclusion of the Sales Agreement
4.1. Orders can be placed via forms available on the Store’s website.
4.2. The Customer is required to provide accurate personal data: name, address, email, and phone number.
4.3. After receiving an order, the Seller confirms receipt and acceptance via email. Upon confirmation, the sales agreement is concluded.
4.4. The agreement is documented by providing these Terms on the website and sending confirmation to the Customer’s email.
4.5. Orders can be placed 24/7 throughout the year.
§5 Payment Methods and Deadlines
5.1. Payments can be made via:
– bank transfer
– external payment providers
5.2. After placing an order, the Customer receives payment details via email. The order is processed once payment is received.
5.3. Payments may also be made via the external payment provider Blue Media.
5.4. Payment must be completed within 7 calendar days from the date of the agreement.
§6 Delivery
6.1. Digital products are delivered to the email address provided in the order.
6.2. Delivery time is up to 48 hours. The Seller will make every effort to deliver within the stated timeframe. If delivery is delayed, the Customer will be informed.
§7 Right of Withdrawal
7.1. A Consumer or Entrepreneur with consumer rights may withdraw from the contract within 14 days without providing a reason.
7.2. To exercise this right, the Customer must notify the Seller via email or written statement before the deadline.
7.3. Late withdrawal statements do not produce legal effects.
7.4. The Seller will confirm receipt of the withdrawal request.
7.5. All payments will be refunded within 14 days from receipt of the withdrawal notice.
7.6. Refunds will be made using the same payment method, unless otherwise agreed.
7.7. The right of withdrawal does not apply to cases specified in Article 38 of the Consumer Rights Act.
7.8. By entering into the agreement, the Customer confirms awareness of the withdrawal rights.
§8 Complaints
8.1. The Seller’s liability is governed by applicable law and these Terms.
8.2. The Seller is obliged to provide products free from defects.
8.3. Complaints should include a description of the defect, date, request, and contact details.
8.4. The Seller will respond within 14 days. Lack of response means the complaint is accepted.
